1. Definitions
In these Terms and Conditions, the following terms have the meanings assigned to them:

- —"User," "You," or "Your" means any individual who accesses our website or enrolls in one of our courses.
- —"We," "Us," or "Our" means Garuda Tech, located at 67/12 Sukhumvit Road Soi 31, Khlong Tan Nuea, Bangkok 10110, Thailand.
- —"Content" means all course materials, videos, written resources, exercises, and other materials accessible through our Services.
- —"Learner" means a User who has enrolled in and is actively participating in one of our courses or programmes.
2. Acceptance of Terms
By accessing our website, submitting an enquiry, or enrolling in a course, you confirm that:

- —If accessing on behalf of an organisation, you have the authority to bind that organisation to this Agreement.

3. Service Description
Garuda Tech provides online AI development courses and programmes, currently including:
- —AI Ethics and Responsible Practice (฿4,200) — A course on ethical considerations in AI development, suitable for both technical and non-technical learners.
- —Recommender Systems and Personalization (฿16,800) — A practical course requiring prior ML knowledge, covering collaborative filtering, content-based methods, and hybrid approaches.
- —Full-Stack AI Application Programme (฿35,000) — A five-month programme for learners with prior software engineering experience, covering end-to-end AI application development.
Course content is delivered primarily online. We reserve the right to modify, update, or improve course materials at any time. Where significant changes are made to enrolled course content, we will communicate this to affected learners.
We endeavour to maintain reasonable service availability, but do not warrant that access will be uninterrupted or error-free at all times.
4. Learner Accounts
To participate in a course, you may be required to create a learner account. You are responsible for:

- —Maintaining the confidentiality of your account credentials.
- —All activity conducted through your account.
If you believe your account has been compromised, please notify us promptly at [email protected]. We may suspend or terminate accounts that we believe have been accessed by unauthorised parties.
5. User Responsibilities
When using our Services, you agree to:

- —Engage respectfully in any course discussions, peer review sessions, or mentor interactions.
- —Submit your own work and not misrepresent others' work as your own in assignments or projects.
- —Not distribute, reproduce, or share course materials with individuals who have not enrolled.
You agree not to:
- —Attempt to gain unauthorised access to any part of our systems or other learners' accounts.
- —Use automated tools to scrape, download, or harvest content from our platform.
- —Engage in any conduct that could harm, harass, or disrupt other learners or our staff.
- —Use our Services to develop or distribute tools designed to circumvent these terms.
6. Intellectual Property
All course materials, website content, brand assets, and related intellectual property are the property of Garuda Tech or its licensors. We grant enrolled learners a limited, non-exclusive, non-transferable licence to access and use course materials for personal, non-commercial learning purposes only.
This licence does not permit you to copy, reproduce, distribute, publicly display, or create derivative works from our materials without our prior written consent.
Work you produce as part of course assignments or portfolio projects remains your intellectual property. By participating in peer review activities, you grant other enrolled learners a temporary licence to read and respond to your submitted work within the course context.
7. Payment & Refund Policy
Payment
Course fees are quoted in Thai Baht (฿). Payment is due at the time of enrolment unless alternative arrangements have been agreed in writing. We accept payment by the methods specified during the enrolment process.
Refund Policy
- —Within 7 days of enrolment: A full refund may be requested if you have not yet accessed course materials.
- —After accessing materials: Refunds are considered on a case-by-case basis. Please contact us at [email protected] to discuss your situation.
- —More than 30 days after enrolment: Refunds are not ordinarily available, though we will consider exceptional circumstances at our discretion.
Refund requests should be submitted by email to [email protected] with your enrolment details. Approved refunds will be processed within 14 business days.
8. Course-Specific Terms
Enrolment and Access
Upon successful enrolment and payment, you will be provided with access details for the relevant course or programme. Access is granted for the duration of the course as specified at the time of enrolment.
Prerequisites
Some courses specify prerequisite knowledge. It is your responsibility to review these before enrolling. We cannot offer refunds where a learner finds the material inaccessible due to unmet prerequisites that were clearly stated.
Academic Integrity
All submitted work must be your own. Presenting others' work as your own, or using automated tools to generate assignment submissions without disclosure, is a breach of academic integrity and may result in removal from the course without refund.
Mentor and Peer Review Sessions
Where mentor sessions or peer code review are included (as in the Full-Stack AI Application Programme), these are provided as a learning resource and are not a consulting or professional advisory service. Scheduling is subject to reasonable availability.
9. Disclaimers
Our Services are provided on an "as is" and "as available" basis. To the extent permitted by applicable law, we make no warranties, express or implied, regarding:
- —The accuracy, completeness, or currency of course content.
- —That the Services will meet your specific learning objectives or career outcomes.
- —That the Services will be available at any particular time or without interruption.
Our courses are educational in nature. We make no representations regarding employment outcomes, salary changes, or professional advancement that may or may not result from course participation.
10. Limitation of Liability
To the fullest extent permitted by Thai law, Garuda Tech's total liability arising from or related to this Agreement or the use of our Services shall not exceed the amount paid by you for the specific course or programme giving rise to the claim in the twelve months preceding the event.
We shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of or inability to use our Services, including but not limited to loss of earnings, data loss, or reputational harm.
Nothing in these terms excludes or limits liability that cannot be excluded under applicable Thai consumer protection law.
11. Indemnification
You agree to indemnify and hold harmless Garuda Tech and its staff from any claims, losses, damages, or costs (including reasonable legal fees) arising from your use of our Services in a manner that violates this Agreement, infringes any third-party rights, or violates any applicable law.
12. Termination
We reserve the right to suspend or terminate your access to our Services without prior notice if we determine that you have materially violated this Agreement, engaged in conduct harmful to other learners or our staff, or provided false information during enrolment.
You may withdraw from a course at any time, subject to the refund policy set out in Section 7.
Upon termination, provisions of this Agreement that by their nature should survive (including intellectual property, indemnification, disclaimers, and limitation of liability) will continue to apply.
13. Dispute Resolution
These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any disputes arising from or related to this Agreement shall be subject to the jurisdiction of the courts of Bangkok, Thailand.

Thai consumer protection rights under the Consumer Protection Act B.E. 2522 and related legislation are not affected by these terms.
14. General Provisions
- —Entire Agreement: This Agreement constitutes the entire agreement between you and Garuda Tech regarding use of our Services and supersedes any prior discussions or arrangements.
- —Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- —Waiver: Failure to enforce any provision does not constitute a waiver of our right to do so in the future.
- —Assignment: You may not assign your rights under this Agreement without our prior written consent. We may assign our rights in connection with a business transfer.
- —Notices: Formal notices should be sent by email to [email protected] or by post to our registered address.
15. Changes to These Terms
We may revise these Terms and Conditions from time to time. When we make material changes, we will update the effective date at the top of this page and, where we have your contact details, notify you by email with reasonable notice before changes take effect.
Continued use of our Services after the effective date of revised terms constitutes acceptance of those terms.
